Booking Conditions

1. General

The purpose of ‘Blue Beyond Ltd.' is to act exclusively as a letting agent and the booking contract will be made solely between the owner(s) of the property in question and the person who signs the contract as a holidaymaker. The name and address of the owner can be provided on request. The company is registered in England with registered address 19 Meadow Drive, Pilmere, Saltash, Cornwall, PL12 6XJ with company number: 5846214.

2. Deposit

Should a booking be made prior to 6 weeks before the date of the holiday a deposit of 1/3 of the rent is required. If the booking is made within the 6 weeks before the holiday then the full rent must be paid at the time of booking. If a booking is not accepted then the fees received by the Agents will be refunded at once.

3. Payment

The balance of the rental must be paid by the applicants 6 weeks before the start of the holiday. Non-payment by the date set may be treated as a cancellation. Should this be the case a cancellation charge will be enforced, refer to 5.Cancellation. The Agents are not obliged to send reminders but the date set will be made clear once the booking is confirmed.

4. Altering a booking

As soon as a booking has been confirmed by the Agents the booking can only be changed to another cottage by treating the original booking as a cancellation, refer to 5.Cancellation. The date of the holiday may be changed providing the cottage is available on the new date and the cottage owners have agreed to the change. There is a re-booking fee of £20 in either event.

5. Cancellation

Cancellations must be notified in writing within seven days of the event causing cancellation. ‘Blue Beyond Ltd.' will refund the full payment received less a £20 administration fee in the event of a death, injury, summons for a jury service or due to illness of any party member, or close relative or business associate of the applicant which, in the opinion of the Agents, reasonably prevents the applicants from being able to take up the booking made. Close relatives are; Wife, Husband, Father, Mother, Brother, Sister, Mother-in-law, Father-in-law and children. ‘Blue Beyond Ltd.' will not however refund any payments for pregnancy or any other related illnesses. If any illness in the opinion of the Agents is insufficiently serious to prevent the person taking the holiday, the booking will not be considered for refunds. It is important to understand that the Agents must be informed of a cancellation before the start of the holiday. Events occurring after midnight prior to the start of the holiday as stated in the Booking Form are not covered for refunds, and a cancellation charge will be enforced based on the number of days before the holiday start date that the cancellation is received in the Agents' office in writing and is specified in the table following;

6. Price Change

‘Blue Beyond Ltd.' reserves the right to amend prices shown on the website due to errors or omissions, or changes in the VAT rate.

7. Payment methods

Payments may be made by credit card, debit card or cheque. Cheques should be made payable to ‘‘Blue Beyond Ltd.''. Post-dated cheques will not be accepted. Any charges raised against the Agents by their bank for handling dishonoured cheques, transfers or any other payments will be passed on to the Applicants who are liable to reimburse the Agents in respect of such charges within a week of receipt of notification from the Agents. Should a direct debit payment fail to be honoured, then the Applicant must revert to paying the deposit and balance as suggested in conditions 2 & 3.

8. Overseas Bookings

Applicants from overseas may pay by Sterling cheque drawn on a UK bank or by MasterCard or Visa in Sterling. Any charges for payments from overseas will be passed onto the Applicants.

9. Eligibility

Bookings will be considered and will be at the discretion of the Owners/Blue Beyond Ltd. for:

i) All male or all female groups comprising more than 4 people.

ii) Groups of single persons under the age of 18 unless accompanied by an adult over the age of 25.

10. Obligations of the Tenants

The Tenants agree to:

i) Pay for any losses or damages to the property caused by the Tenant, a member of their party or the Tenants' guests. The cottage owners will inform the Agents of such incidents. Reasonable wear and tear is excluded.

ii) Pay for all gas, electricity, fuel, telephone charges or any other such charges incurred during a tenancy, if stipulated.

iii) Permit the cottage owners and Agents reasonable access to the property.

iv) Not exceed the number of people stipulated in the property description.

v) Behave in a sensible and civilised manner so not to upset occupants of adjoining properties.

vi) Leave the property in a clean and tidy state after their holiday and not to remove any possessions of the property on leaving. A cleaning service is not provided during the holiday unless stated.

11. Liability

The Owner accepts no liability for loss of or damage to the Tenants' possessions on the Owners' property or land. The Agents do not accept liability for any act, neglect or default on the part of the Owners or any other persons whom they employ or who are otherwise under their control, nor for any accident, damage, loss, injury, expense or inconvenience, whether to person or property, which the Tenants or any other person may suffer or incur arising out of or in any way connected with the letting.

12. Non-availability of properties

If for unexpected reasons beyond the Owners' control the property is not available on the date booked or the property is unsuitable for holiday letting, all rent and charges paid in advance by the Applicants will be refunded in full. The Applicant will have no further claim against the Owners or the Agents.

13. Duration and times of letting

Lettings can only be made for a maximum of 4 weeks at any one time, and commence at 3.00 pm on the first day of the occupancy and finish at 10.00 am on the day of departure unless otherwise notified. The period booked cannot be exceeded unless the Agents give written approval. The Tenants will be liable for any cost of whatsoever nature incurred because of an unauthorised extension.

14. Descriptions

The descriptions of the properties are decided upon between ‘Blue Beyond Ltd.' and the Owners of the properties in question. This is done in good faith and in the belief that they are correct. Descriptions are general and not absolute. The Tenant accepts that local amenities such as pubs, shops, sports facilities etc., are a guide only to what is available in the locality and that these amenities may vary in detail from mentioned or be closed or no longer in operation when the Tenants arrive.

15. Complaints

Complaints must be notified to the Agents immediately so that a direct response can be made if necessary and quick action taken if required. In no circumstances will compensation be made for complaints raised after the tenancy has ended when the Tenant has denied the Agents or Owners the opportunity to investigate the complaint at the time of the tenancy.

16. Pets

Pets (maximum of two) are only permitted with consent of both Agents and Owners; this is brought to notice on booking. Pets are not permitted on the furniture nor allowed in the bedrooms. The Agents and Owners cannot accept responsibility for their safety. Pets must not be left in the property unsupervised at anytime during the tenancy. A weekly charge will be made for each pet.

17. Inventory

Should an inventory be provided, any discrepancies are to be reported to the Owner within 24 hours of arrival, otherwise the inventory will be deemed to be correct.

18. Linen

Linen is changed between tenancies and weekly during tenancies. Towels, tablecloths and tea towels are not always provided and Tenants should bring their own unless otherwise notified.

19. VAT

The majority of Owners' cottages on the ‘Blue Beyond Ltd.' website are not VAT registered and therefore there is no tax payable. Where VAT is payable the tax is included in the weekly rent.

20. Breach of contract

If there shall be a breach of any of these conditions by any of the Tenants, the Owners or the Agents reserve the right to re-enter the property and terminate the tenancy without prejudice to the other rights and remedies of the Owners. This event will be treated as a cancellation and no refund will be given.

21. Governing law and jurisdiction

The contract is deemed to have been made at the following address: 19 Meadow Drive, Pilmere, Saltash, Cornwall, PL12 6XJ. The validity, construction and performance of this agreement shall be governed by English Law. The Applicants and the Tenants submit to the exclusive jurisdiction of the English courts.

22. Authority to sign

The person who completes the booking form confirms that:

i) He or she is authorised to agree the Booking Conditions on behalf of all persons included on the booking form, including those substituted at a later date.

ii) The signatory is over 18 years old and a member of the party intending to occupy the property.

iii) He or she agrees to take responsibility for the party occupying the property.

23. Discrepancies

In the case of a discrepancy between these Booking Conditions and the other contents of a ‘Blue Beyond Ltd.' website, these conditions shall prevail.

24. Validity Clause

If any term or provision in these Booking Conditions shall in part be held to any extent to be illegal or unenforceable under any enactment or rule of law that term or provision or part shall to that extent be deemed not to form part of this agreement and the enforceability of the remainder of this agreement shall not be affected.

25. Discounts

Discounts are only valid using our given reference numbers. Discounts only last up to 12 months after they were issued.
